Why Students with Disabilities Struggle

These challenges are not about lack of intelligence or effort. They stem from a mismatch between how schools teach and how some students learn. Understanding this is the first step toward getting proper support.

Cognitive and Learning Differences

Students with dyslexia struggle with reading comprehension. Those with dysgraphia find writing physically or cognitively challenging. Autistic students may have difficulty with abstract thinking or figurative language. Executive functioning challenges — planning, time management, task initiation — make keeping up with assignments extra difficult.

Communication Barriers

Some students are nonverbal or rely on alternative communication. Even verbal students may struggle with pragmatic language — the social use of language — which impacts classroom participation and peer collaboration. Without proper support, this leads to frustration and disengagement.

Sensory Processing Difficulties

Many autistic students are hypersensitive to lights, sounds, or textures. A typical classroom — full of noise, movement, and visual stimuli — can cause sensory overload that makes focusing, processing information, or even staying in the room extremely difficult.

Social and Behavioral Challenges

Schools are inherently social. Autistic students often struggle to interpret social cues, form relationships, or manage anxiety in group settings. This can lead to isolation, bullying, or exclusion — all of which significantly harm academic performance and well-being.

Limitations of Traditional Education

Schools are largely designed for neurotypical learners. Standardized teaching, rigid curricula, and limited teacher training in special education mean students with disabilities often do not receive the individualized support they need — despite it being their legal right.

Federal law guarantees students with disabilities a free, appropriate public education with the support they need. Many families do not know what they are owed. That changes here.

IDEA 2004

Individuals with Disabilities Education Act

Guarantees all eligible children ages 3-21 a Free Appropriate Public Education (FAPE). Schools must provide an Individualized Education Program (IEP) developed with family input, in the Least Restrictive Environment.

Section 504

Rehabilitation Act

Prohibits disability discrimination in federally funded schools. Students who do not qualify for an IEP may qualify for a 504 Plan providing accommodations like extended time, preferential seating, or assistive technology.

ADA

Americans with Disabilities Act

Prohibits discrimination against people with disabilities in all public life including schools. Ensures physical accessibility, equal program access, and extends protections to colleges and workplaces.

Your Rights Checklist

Free Evaluation at No Cost

Schools must evaluate your child for a disability at no cost if you suspect they have one. Request this in writing. The school must respond within 60 days in most states.

IEP Within 30 Days of Eligibility

Once eligible, the school must develop an IEP within 30 calendar days. You are a required member of the IEP team and must give written consent before services begin.

Least Restrictive Environment

Your child has the right to be educated alongside non-disabled peers to the maximum extent appropriate. Schools cannot automatically place students in separate classrooms without justification.

Right to Dispute and Due Process

If you disagree with school decisions, you can request mediation, file a state complaint, or pursue due process — a formal hearing. You can also request an Independent Educational Evaluation (IEE) at public expense.

Red Flags — Possible Violations

Watch for: refusing to evaluate, holding IEP meetings without you, failing to implement services, pressuring you to sign documents, punishing disability-related behaviors without a behavior plan. Contact your state PTI immediately if this happens.
